Practice Areas

The estate planning attorneys at the Law Office of Bruce Hudson Towne have substantial experience in providing the full breadth of estate planning, business succession and tax planning, trust administration and litigation, probate administration and litigation, conservatorship, and financial elder abuse representation. We represent clients in Carmichael and throughout Sacramento, Placer, and El Dorado counties.

Estate Planning

Our attorneys understand that every client's situation is unique, and we take a personalized approach to estate planning, investing the time necessary to understand our client’s family dynamics, finances, and estate planning objectives. We carefully craft estate plans that accomplish our client’s goals while seeking to minimize or eliminate any transfer tax consequences and eliminate the necessity for probate administration. We take into consideration various contingencies, including the possibility of subsequent incapacity. Whether you are a single individual seeking to ensure that your assets will be distributed to your intended beneficiaries, or are part of a blended family arrangement and wish to protect the interests of your children from a prior marriage, we can prepare an estate plan customized to your needs. We assist clients with:

  • Wills
  • Revocable Living Trusts, Formula Trusts, Disclaimer Trusts
  • Financial Powers of Attorney
  • Advance Directives for Health Care
  • Irrevocable Trusts, including Irrevocable Life Insurance Trusts
  • Business Succession Planning
  • Gifting Strategies

Probate Administration and Trust Administration

Our attorneys also have extensive experience in probate administration and trust administration, ranging from the administration of insolvent probate estates to the administration of large, complex estates involving federal estate tax and generation-skipping transfer tax issues. We also assist clients with petitions to determine entitlement to distribution of a decedent’s estate and heirship.

Conservatorship Representation

In the event a person becomes incapacitated, and does not have estate planning documents in place designating who will manage their financial affairs or make decisions regarding their care, we can assist in obtaining the appointment of a conservator of the person and/or of the estate, and can advise the conservator of their fiduciary duties and obligations. We also assist proposed conservatees and their family members in objections to the appointment of a conservator.

Financial Elder Abuse

Our attorneys have significant experience in the area of financial elder abuse, and represent clients in cases involving allegations of an abuse of fiduciary power, abuse involving a power of attorney, fraud, misconduct or undue influence by persons in a position of trust or confidence, such as a caregiver or financial planner, or other instances of financial elder abuse. California has enacted laws substantially expanding the rights of financially exploited elders, allowing for the recovery of attorneys’ fees and costs, restitution, and punitive damages in a civil action for financial elder abuse.

Trust & Estate Litigation

Our attorneys represent clients in probate, trust, and conservatorship litigation matters before the Superior, Appellate and Supreme Courts of the State of California. We represent trustees, executors, administrators, conservators, beneficiaries and other parties in all manner of trust and estate disputes, including but not limited to:

  • Challenges to the validity or construction of a will (will contests), trust or other estate planning document
  • Allegations of fraud, coercion, undue influence or elder abuse
  • Allegations of a breach of fiduciary duty
  • Enforcing beneficiary rights
  • Creditors’ claims
  • Trust or estate accounting issues
  • Intra-family conflicts

We are committed to resolving conflicts in the most expeditious and cost-effective manner possible, often utilizing alternative dispute resolution methods including negotiation and mediation. When a matter cannot be settled, we are experienced litigators with an established track record of achieving successful results on behalf of our clients, and a reputation in the legal community for favorably resolving difficult and challenging cases.
